General Conditions of Use and Sale

Acus Sound Engineering S.r.l. provides access to the website www.acus-sound.it/shop and offers products for sale in accordance with the following General Conditions of Use and Sale.

Please, we invite you to read these General Conditions carefully before using our website and purchasing any products.

By visiting our site and/or purchasing something from us, you agree to be bound by the following General Conditions. Furthermore, if you wish to use any services provided by us, now or in the future, you will be also subject to the Terms, Guidelines and General Conditions applicable to that specific service (“Service Terms”). In case of conflict between the General Conditions of Use and Sale and the Service Terms, the Service Terms shall prevail.

I) GENERAL CONDITIONS OF PRODUCT SALE

This section contains the terms and conditions of product sale through the Acus Sound website where Acus Engineering S.r.l. is the seller.

  • OUR CONTRACT

The display of products and services on our website is an offer to buy.

I you want to purchase one or more products displayed on our website, you have to add a product to your basket at a time, proceed to checkout after you have reviewed the items in your Shopping Basket and place the order.

Afterwards, it will come up a summary of the selected products and the total price, including the delivery costs.

You will be asked to select your delivery, shipping preferences, and payment method.

In the same web page you will find the button “Buy”. You need to click on the “Buy” button to place your order and then, your order will be considered as an offer to buy from Acus Sound Engineering S.r.l.

When receiving your order, we will automatically send you an email confirming receipt of your order (the “Order Confirmation Email”) which it does not confirm acceptance of your offer to buy the product. We are only confirming that we have received your order and undertook the process to verify the data and availability of the products requested.

We only conclude the contract of sale when we send you a confirmation email of acceptance of your order confirming to you that we have dispatched the product with the estimated delivery date (“Dispatch Confirmation Email”).

Without affecting your right of cancellation set out in section 2 below, you can cancel your order for a product at no cost any time before we send the Dispatch Confirmation Email relating to that product but only if the order is still not ready for the shipping process. Any product selected in an order of purchase that has not been accepted with a Dispatch Confirmation Email will not be part of the contract of sale.

All orders placed on our website need to correspond to the typical needs of a normal household.

2. RIGHT OF CANCELLATION, EXCEPTIONS AND RETURNS GUARANTEE POLICY OF ACUS SOUND ENGINEERING

Unless one of the exceptions listed below applies, you can cancel your order without giving any reason within 14 days from the day on which you received the goods purchased (or last good, lot or piece if it relates to goods or multiple lots or pieces delivered separately) or from the day of the conclusion of the contract, in the case of services or digital content not supplied in a tangible medium (e.g. CD or DVD).

If a third party indicated by you (other than the carrier) receives the products, you can cancel your order from the day on which the third party receives the goods purchased.

You must inform us (Acus Sound Engineering S.r.l.) of your decision to cancel your order (i); you may submit your request according to the instructions available on our Customer Service, (ii) by using the function “Contacting us” or (iii) using this form. In case you use our Customer Service, we will communicate to you an acknowledgement of receipt by email. To meet the cancellation deadline, it is sufficient for you to send your communication before the 14 days’ cancellation period has expired and return the product to Acus Sound Engineering S.r.l. following the instructions given by our Customer Service.

3. EFFECTS OF CANCELLATION

We will reimburse all payments received from you for the goods purchased and will also reimburse the delivery charges for the least expensive type of delivery offered by Acus Sound Engineering S.r.l, no later than 14 days from the day on which we received the above communication regarding the right of cancellation. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.   We may withhold reimbursement until we have received the products back or you have supplied evidence of having sent back the goods to Acus Sound Engineering, whichever is the earliest. Please, notice that you must send back the products by following theinstructions given by our Customer Service no later than 14 days from the day on which you communicated your cancellation. You will have to bear the direct cost of returning these goods. You may be liable if the value of the products returned diminishes due to the handling of the goods (except when it was necessary to establish the nature, characteristics and functioning of the products).

4. EXCEPTIONS TO THE RIGHT OF CANCELLATION

The right of cancellation does not apply to:

  • the delivery of products which are not suitable for return due to hygienic reasons or health protection if unsealed by you after delivery, or which are, after delivery, inseparably mixed with other items;

  • the delivery of sealed audio or video recordings or of sealed software if unsealed by you after delivery;

  • the supply of goods made to your specifications or clearly personalized;

  • the supply of goods which may deteriorate or expire rapidly;

  • services, if Acus Sound Engineering S.r.l. has fully performed the services after you expressly requested that we begin to supply the services and after you acknowledged that you would lose the right to cancel once we had fully performed them;

  • the supply of digital content (including apps, digital software, e-books, MP3, etc.) which is not supplied on a tangible medium (e.g. on a CD or DVD) if you accepted when you placed your order that we could start to deliver it, and that you could not cancel it once delivery had started;

  • the delivery of journals, newspapers, or magazines with the exception of subscription contracts;

5. THE RETURNS GUARANTEE POLICY OF ACUS SOUND

Without prejudice to your statutory rights, all the products purchased from Acus Sound Engineering S.r.l. can be returned within 365 days of receipt of the products to us if the products are complete and are in an unused and undamaged condition. For sealed products we only take back the products in the unopened shrink wrap film or with an undamaged seal. The products are to be returned following the instructions given by our Customer Service.

According to this returns guarantee, we will refund the purchase price already paid by you but not the shipping costs of your initial purchase. Likewise the transport risk and return costs are borne by you. This returns guarantee is additional and does not affect your statutory rights and therefore does not affect your right of cancellation within 14 days as described above.

6. PRICING AND AVAILABILITY

We list availability information for products sold by us on the website including on each product information page.  Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please, note that the estimated dispatching and delivery time are merely approximate and should not be relied upon as such. As we receive your order, we will inform you by email if any products you have ordered turn out to be unavailable.

Despite our best efforts, a small number of the products in our catalogue may be mispriced. We will always verify pricing when processing your order and in the dispatching process. If a product's correct price is lower than our stated price, we will charge the lower amount and send you the product. If we have made a mistake and the price on the website, is lower than the product’s correct price of sale, we will not be able to accept your order. In this case, you may place a new order to purchase the product at the correct price of sale.

All prices are inclusive of VAT, unless stated otherwise.

7. CUSTOMS

When ordering products from Acus Sound for delivery outside of Italy you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you. We have no control over these charges and we cannot estimate the costs. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from our website you are considered the importer and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care how your personal data is treated and shared. We would like our international customers and our customers who dispatch abroad to be aware that cross-border deliveries are subject to opening and inspection by customs authorities. 

8. PRODUCT GUARANTEES AND LIMITATION OF LIABILITY OF THE PRODUCTS SOLD BY ACUS SOUND

The Legal Guarantee on products sold by Acus Sound Engineering S.r.l. applies only when the buyer is a consumer on a non-professional basis and not a professional buyer in accordance with Directive 1999/44/E on certain aspects of the sale of consumer goods and associated guarantees.

Purchasing in quality of a "consumer", you benefit from the Legal Guarantee that traders selling consumer goods are obliged to meet by law ("Legal guarantee").

Sellers of products – and Acus Sound Engineering S.r.l. is a seller – are obliged to guarantee to consumers that products are in conformity with the relevant contract of sale.

According to the law, when the Legal Guarantee applies, you are entitled to ask for faulty goods to be repaired or replaced free of charge or may instead ask for an appropriate price reduction if the product cannot be repaired or replaced or ask to dissolve the  contract. Acus Sound Engineering S.r.l. is liable for any defects of conformity that appear within 2 years from the date of delivery. You must inform the seller of the fault within two months of discovering it.

Acus Sound Engineering S.r.l. declines every responsibility in case the item delivered is not compliant with the laws of the country in which it is delivered within the bounds of the law.

Acus Sound Engineering S.r.l. will not be responsible for non-substantial differences between the goods, its illustrative images and the descriptions published on our web site.

Unless malice or intentional wrongdoing, we are only responsible for any direct and predictable damage at the conclusion of the sales contract. We are therefore not responsible for any contingent loss, missed gain or any other damage which is not direct and immediate consequence of our negligence or which can not be predictable before the conclusion of the sales contract.

Acus Sound Engineering S.r.l. will not be held responsible for any third party obligations that may offer commercial guarantees, arising in connection with the products for sale on the website.

If you breach these General Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

23. GOVERNING LAW AND JURISDICTION

These conditions are governed by and construed in accordance with the laws of Italy and the European Community. You agree to submit to the non-exclusive jurisdiction of the Italian courts.

Where does Acus Sound Engineering S.r.l. ship its products?

Acus Sound Engineering S.r.l. ships to the following countries inside the European Union: Bulgari, Cyprus, Croatia, Estonia, Finland, Leetonia, Lithuania, Malta, Portugal, Romania, Slovakia, Slovenia, Spain, and Hungary.

What are the shipping costs?

Shipping costs vary and there will be within a minimum of €30 and a maximum of € 120.

The shipping costs are the same for all the shipping destinations. If you place more than one order, the shipping costs will be charged for each order placed. Orders will not be automatically combined if they are delivered to the same delivery address.

Please, notice that we will only take payment for the price of the order, using the selected payment method, when your order is ready for shipping. If we have problems charging your chosen method of payment, the shipment may be delayed. If we are not able to dispatch your order for any reasons, the price will not be charged to you.

When will I receive my order?

For items stocked in our warehouse at the time of placing the order, we aim to process orders and dispatch them within a few hours of receiving an order up to 5 working days.

If your order contains multiple items, they may be sent separately in more than one delivery.

Once your items are dispatched, you will receive a dispatch notification email confirming the details of the product you bought and the estimated delivery time to your address.

Notice: If your order contains large volume items, you will see the estimated delivery time in the dispatch notification email but the delivery time will be confirmed by the courier that may contact you in order to make an appointment.

My parcel has not arrived

Please check the section My Orders in the My Account section to be sure that your order has been dispatched. When we dispatch your order, we will send you a dispatch notification email with the estimated delivery time to your chosen address.

If your order has been dispatched, you will find the information regarding the courier that delivers your parcel in the section My Orders and the dispatch notification email. Furthermore, you may track your order in the courier’s web site.

Please contact us if your order does not arrive by the scheduled date and the courier does not know where your parcel is.

About delivered parcels that you have not receive

If tracking your order, you can see the parcel has been delivered, we suggest you to verify if the courier has not delivered the parcel to the building porter (in case, there is one) or a neighbour. Otherwise, please contact us.

About undeliverable parcels

Occasionally parcels are sent back to Acus Sound Engineering S.r.l. when a courier returns a parcel as undeliverable. Your order might be returned as undeliverable for several reasons:  

Wrong address: If the address is incorrect or is not recent, the goods will be notified ad stored package for a short time depending on the courier. Then, the package will be automatically returned to our distribution center. Please double-check the delivery address carefully when placing your order.

Post-Office Box addresses: If the format chosen for the delivery to a Post-Office Box is different from the standard format, the parcel might have been sent by a courier that does not deliver to Post-Office Boxes. In order to send a parcel to a Post-Office Box, please double check you write “Post-Office Box “next to the numbers in the address blank on the form.

Other address issues: If the order has been shipped to a prison or a military address, our couriers may have not received the authorization to deliver the goods.

Illegible shipping label: The shipping label could become illegible during shipment, but this happens very rarely.

If you already know that your order has not been delivered or you have not received any notification of its return to our distribution center after 2 weeks of the expected delivery date, please contact us.

My product isdamaged/defective/wrong

Please, contact our Customer Service to know how to return your product. You will benefit from our suggestions and obtain a full refund if the return is a result of a defective, damage or wrong item.

If the product you purchased from the Acus Sound Engineering S.r.l.’ s site has been delivered damaged, defective or is not the product you ordered or is not in conformity with the sales contract you may also claim using the Legal Guarantee. Every product that Acus Sound Engineering S.r.l. sells to consumers is protected under the Legal Guarantee on the sale of consumer goods for any products that lack in conformity with the contract of sale for a period of two years after the delivery of the goods.

What is the Legal Guarantee?

It is the guarantee on the sales of consumer goods under the EU Directive, also known as "guarantee of conformity", which protects you if the products purchased have conformity defects respect to the sales contract (“Legal Guarantee”).

For example, this happens, when products function badly, are faulty, they cannot be used according to the methods declared by the seller or for the purposes for which products of the same type are generally used, do not have the characteristics or qualities promised by the seller or do not respond to the use for which they were purchased.

What is the duration of the Legal Guarantee?

The Legal Guarantee covers conformity defects which occur within 24 months from the date of delivery of the product you have purchased, even if on that date the defect was not immediately noticeable. For the claim to be valid, the seller must be informed of the presence of the defect within 2 months from detection of the same.

Unless proved otherwise, it is assumed that any conformity defects which occur within the first 6 months from the date of delivery of the goods already existed on that date, unless this presumption is incompatible with the nature of the goods or the nature of the conformity defect.

We recommend that you always save your sales invoice, which is included in the packaging of the product, as well as confirmation documents regarding shipment and delivery of the product.

Do I have rights to the Legal Guarantee?

Only the consumer has rights regarding the Legal Guarantee, i.e. those who buy products for non-business purposes. For example, if you purchase a laptop computer solely for your own personal use, you are entitled to the Legal Guarantee. If this is not the case and you purchase it for your business, the Legal Guarantee does not apply.

Against whom can I enforce the Legal Guarantee?

If you are a consumer you have the rights under the Legal Guarantee against the seller of the product, even if the seller is not the producer. For the products purchased from us, Acus Sound Engineering S.r.l. is directly responsible.

What rights does the Legal Guarantee give me?

If the product you have purchased has a defect covered by the Legal Guarantee, you are entitled, without having to incur any expense, to the repair or replacement of the defective product by the seller. You have the right to a price reduction or termination of the contract in the following cases: (a) if replacement or repair of the product are not possible or are excessively expensive, (b) if the seller has neither repaired or replaced the product in a reasonable period of time, or (c) if the replacement or repair of the product has caused you significant inconvenience. To determine the amount of reduction of the price or amount to which you are entitled, in these cases the use you have made ​​of the product is taken into account. Keep in mind that a minor defect, for which it was not possible or is too costly to repair or replace does not give the right to terminate the contract.

What should I do in the presence of a conformity defect?

If the product you have purchased from Acus Sound Engineering S.r.l. has been delivered damaged, is faulty, is not what you ordered or however is not in conformity with the sales contract, please contact our Customer Services. Our Customer Service operators will help you solve the problem with the product you have purchased.

If it emerges that the problem derives from a conformity defect, proceedings will be opened in your name and you will be given a code for the repair or replacement of the faulty product free of charge. 

Remember that, in the case of replacement, we will deliver the replacement product within a reasonable time period and you must return the non-conform product to us within 30 days from the delivery date of the replacement product.

Returns Policy of Acus Sound Engineering S.r.l.

You may return any goods purchased from Acus Sound Engineering S.r.l. for any reason within 365 calendar days from the delivery date, except where prohibited by applicable law. To verify the exclusions applied, please visit the page Right of Cancellation.

If you have purchased the goods as a “consumer “and you return the products within 14 calendar days from the delivery date we will give you a refund for:

The cost of the product purchased that you are returning.

The delivery costs paid to have the item delivered (we will refund the cost of the least expensive type of standard delivery offered by us).

Instead, if you return a product after 14 calendar days but up to 365 calendar days from the delivery date, or otherwise if you buy the products as a” professional buyer” we will only give you a refund for the cost of the product .

In all the cases where you return a product using your right of cancellation, the direct cost of returning these goods will be at your own expense.

To make returning an item to us easier, items should whenever possible be returned in their original packaging, including: internal protections bags, packages, cardboard boxes and labels. If the returned goods are damaged due to unreasonable wear and tear of the product which is not necessary to establish the nature, characteristics and functioning of the products, the loss of value may be deducted from any reimbursement.

If you return a product that contains items that are classified as hazardous, please follow the instructions described in the specific section.

How to return a product

To start the return process, please contact our Customer Service. In this page you will find the detailed complete instructions. You may package and ship your return following these easy steps:

1 Include a copy of your invoice (original or copy) that you will find inside the package.

2 Package your items.

3 Use whenever possible, the original cardboard box of Acus Sound Engineering S.r.l. along with the original packaging. 

4 Send your package using a courier of your choice or the post office. If the product is returned to us under the right of the Legal Guarantee of conformity, we will refund you the cost of your return shipping costs.

5 To make sure you receive the correct refund, please do not put in the same package items belonging to other orders.

We recommend keeping a copy of the return shipment confirmation.

Returning products that contain hazardous materials

Some products are classified as dangerous goods under the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR). They are products that contain substances which are flammable, pressurized, corrosive, damaging to the environment or harmful. Due to their nature, these products are subject to specific guidelines and delivery restrictions. 

Lithium batteries

If the item you want to return contains damaged lithium batteries please detach them from the item before returning the product.  If the damaged battery can't be detached, please dispose it in the nearest recycling centre and contact our Customer Service for further information. Be aware that Acus Sound Engineering S.r.l. reserves the right to request proof of such disposal at any time, so please make sure that you obtain appropriate evidence from the recycling centre you use.

Returning products due to an error, damage or defects

For items that need returning due to an error on our behalf or because they are damaged or defective items, or the order was incorrect and it has been impossible to repair it, we will refund the cost of the item, delivery costs incurred in sending the item to you, and the costs of returning it to us.

Acus Sound Engineering S.r.l. will check over all items returned as damaged or defective. In the event that we disagree with the damaged/defective goods claim, we reserve the right to charge you for the shipping costs and re-charge you for the item. Returning products within 365 days

You can return the items purchased from Acus Sound Engineering S.r.l. within 365 calendar days from the delivery date. In this case, we will refund the price paid for the item. We will not refund the delivery costs incurred in sending the item to you. We will not reimburse the shipping costs of returning the product to Acus Sound Engineering S.r.l and they will be at your own expense.

Therefore does not affect your right of cancellation within 14 calendar days from the delivery date. For further information, please check the paragraph regarding our Returns Policy.

The shipping costs of returning products

The shipping costs of returning products are the costs incurred to send back your products to Acus Sound Engineering S.r.l. If you are not happy with the product you purchased and you want to return it according to our Returns Policy, you may send back the product using our Customer Service. The shipping costs of returning the product will be at your own expense.

If you want to return a product because it has been delivered damaged, is faulty or is the wrong product, or is not in conformity with the sales contract, you may return it using our Customer Service. In this case, we will reimburse you in full on receipt of the returned goods in our warehouse. In order to obtain the refund, please keep a copy of the receipt issued by the post office or courier. We will ask you to send it by email with a pdf attachment.

The shipping costs are the delivery costs of your order that will be added up to the total cost of your order during the checkout process. This sum will be shown on the confirmation order page, in the box “Buy”and the total cost of your order.

Our refund policy

When returning products, the quantity and method of the refund may vary depending on whether products have been returned under the Legal Guarantee of conformity or under our Returns Policy.

When and how will I be reimbursed?

The refund will be issued using the same method of payment chosen at the time of the purchase.

Your refund will be issued within 3-5 working days from the date we receive the item you have decided to return to the given address. We will email you a refund confirmation once the refund has been issued.

Note: please, keep in mind that from the date you send back the item to the date it arrives to our Returns Centre it may take about 2 weeks.
